An Overview of Common Trusts

Your last will and testament, drafted in partnership with our estate planning practice, can contain extensive trust provisions. Our attorneys develop these documents after complete and thorough discussions with our clients. We strive to meet our clients' needs, to mitigate taxes and protect their families. Our firm can talk to you about trusts such as the following:

  • Charitable remainder trust: created for charitable purposes as well as tax reduction
  • Credit shelter trust: also known as a bypass trust or A/B trust, often used by couples with combined assets of more than $675,000, a viable method for protecting assets from estate tax
  • Disclaimer trust: similar to a credit shelter trust
  • Generation skipping trust: ensures assets are passed along in further trusts (or dynasty trusts) for future generations, a viable method for avoiding taxes in children's and grandchildren's estates
  • Grantor retained annuity trust: created to transfer assets at reduced values
  • Irrevocable trust: cannot be revoked or amended, offers tax advantages not available with revocable trusts, often involve life insurance policy proceeds
  • Life insurance trust: a type of irrevocable trust used when client's assets exceed estate tax exemption levels
  • Living trust: created while you are living, assets are not involved in the probate Link to Probate process
  • Revocable trust: can be revoked or amended during the individual's lifetime
